Norm Keith

Norm Keith is a senior partner who provides advice and representation to employers in labour, employment, human rights, safety, environmental, regulatory, government and white collar crime investigations and enforcement. He specializes in workplace crisis management and civil, regulatory and government enforcement litigation.

 

Norm is the leading Occupational Health and Safety (“OHS”) lawyer in Canada. He has successfully defended more than 1,000 OHS regulatory, criminal and related charges. He provides proactive compliance advice and training in all industries and sectors. Norm provides strategic advice following workplace accidents and during government investigations. He has written many of the leading OHS books including Canadian Health and Safety Law, Workplace Health and Safety Crimes (4th ed.) and Halsbury’s Laws of Canada Workplace Health & Safety (2nd ed.). Norm was the first lawyer in Canada to become a Canadian Registered Safety Professional (“CRSP”), is a frequent conference speaker, edits the firm’s quarterly OHS newsletter “Do Diligence” and is the longest serving Judge in the prestigious Canada’s Safest Employers annual event.

 

Norm represents businesses in regulatory and white collar crime investigations. He is on the White Collar Crime Committee of the American Bar Association and a regular speaker at the ABA’s annual White Collar Crime Institute. He is a member of the International Bar Association’s White Collar and Business Crimes Committee and an IBA Section Website Officer. He is a member of the Canadian Bar Association’s Anti-Corruption Committee and participated in the CBA submissions regarding Canada’s new DPA regime. Norm was appellate counsel in R. v Karigar, the first individual prosecuted under the CFPOA. He has authored many of the leading texts in this area, Corporate Crime, Accountability and Social Responsibility in Canada (2nd ed.), Insider Trading in Canada (2nd ed.) and Canadian Anti-Corruption Law and Compliance (2nd ed.) and has published numerous related articles and peer review journal articles.

 

Norm’s LEHR advisory practice includes executive compensation, employment contracts, restrictive covenants, HR policies, COVID-19 vaccine policies, workers compensation claims management. Norm’s LEHR litigation practice includes wrongful dismissal, restrictive covenant, fraud recovery, whistle-blower complaints, OHS work refusals, human right claims. OHS prosecutions, labour arbitrations, OLRB hearings, and fiduciary duty lawsuits.

 

Norm has extensive experience in the complex subjects of alcohol & drugs and harassment & violence in the workplace. He has draft policies, provided training, and acted as counsel in litigation for employers. He was counsel for employer’s groups at the Supreme Court of Canada in the Irving Pulp & Paper and Elk Valley Coal cases dealing with alcohol & drugs in the workplace. He has published extensively in these areas, including Human Resources Guide to Preventing Workplace Violence (2nd ed.) and Alcohol & Drugs in the Canadian Workplace (3rd ed.).

 

Norm has completed 5 Ironman distance triathlons, run the New York, Chicago, Toronto and Hamilton marathons and rides in the annual Ride to Conquer Cancer for cancer research at Princess Margaret Hospital. He is has served on numerous charitable boards and most recently was on the board of the Institute of Corporate directors – GTA West.
